Terms of Service & End-User License Agreement

1. Who we are

FCS Shipping LLC ("FCS," "we," "us") is a freight shipping company based in Brooklyn, New York, providing ocean freight services from the United States to St. Lucia and other Caribbean destinations. These terms govern your use of our website, online quoting and payment tools, customer accounts, and related software (together, the "Services").

2. Acceptance of these terms

By using our website, creating an account, requesting a quote, paying an electronic bill of lading (EB/L), or tendering cargo to us, you agree to these terms. If you do not agree, please do not use the Services.

3. License to use our online tools

We grant you a limited, revocable, non-exclusive, non-transferable license to use our website and customer portal for your personal or business shipping needs. You may not copy, modify, resell, reverse-engineer, or interfere with the Services, attempt to access other customers' information, or use the Services for any unlawful purpose.

4. Quotes, estimates, and pricing

Online quotes are estimates based on the cargo details you provide. Final charges are confirmed when cargo is received, measured, and manifested at our warehouse. Pre-priced EB/Ls issued by our office reflect the exact amount due for the cargo described on them. Rates may change without notice; the rate on an issued EB/L is honored until it is paid or voided.

5. Payments

Payments are processed by Stripe, Inc.; we do not store your card numbers. Deposits and EB/L payments are applied to your shipping charges. Where a payment is made in error or a shipment is cancelled before cut-off, contact us at (718) 483-8006 and we will work with you on a refund or credit.

6. Cargo, prohibited items, and documentation

You are responsible for accurately declaring your cargo and its contents. Aerosols, flammables, hazardous materials, currency, and items restricted by U.S. or destination law may not be shipped. We may inspect, refuse, or hold cargo as required by law or carrier rules. International carriage is subject to the terms of the ocean carrier's bill of lading and applicable law, which may limit liability for loss or damage.

7. Liability

To the fullest extent permitted by law, our liability for any claim arising out of the Services or a shipment is limited to the shipping charges paid for the affected shipment, unless additional insurance was purchased or a higher value was declared and accepted in writing. We are not liable for delays caused by weather, carriers, customs, port operations, or other events outside our control. The Services are provided "as is" without warranties of any kind.

8. Your account

You are responsible for keeping your login credentials confidential and for activity under your account. We may suspend accounts used in violation of these terms.

9. Changes

We may update these terms from time to time. The "last updated" date above reflects the current version; continued use of the Services after changes means you accept them.
